How much alimony will I receive?
How much alimony will I have to pay?
There is no specific amount or method of
calculation provided by law. The amount of alimony
an individual may have to pay or is entitled to
receive (if any) depends on numerous factors
including, but not limited to: 1) the length of the
marriage, 2) the ages of the parties, 3) the
respective income situations of the parties, 4) the
ability of each party to contribute to their own
expenses and the expenses of the other party.

Does the mother automatically get
custody of children?
|
No. There remains an out-of-date belief that a
mother automatically gets custody of the children in
the event of a divorce. THIS IS NOT THE LAW. The law
is that in determining who gets custody of the
children, the Court shall apply the standard of
"what is in the best interests of the
child." This standard is utilized by attorneys
in attempting to settle custody disputes and by the
Courts if called upon to resolve the issue.
There are many possible custody
arrangements besides one parent receiving sole,
exclusive custody that can be arrived at either by
agreement or Court Order.
Do I have to wait any period of
time before I file for divorce?
No. Depending on the grounds for
divorce chosen, immediate filing is often available
to a party.
How much does a divorce cost? A. The actual cost involved in obtaining a divorce
varies from case to case and is effected by many
factors that will be discussed in an initial
consultation with one of the members of our firm.

How much does it cost to have an
attorney represent me in my accident case?
|
|
You pay the attorney nothing,
unless he is successful in obtaining a settlement of
recovering a judgment and collecting money on your
behalf.
In the event we do recover money for
you, our fee is fixed, by law as a percentage of the
total amount received. We will explain the sliding
scale of "contingent" fees at your first
consultation, for which there is no charge in any
personal injury matter. We will advance all costs
and expenses of preparing and presenting your case,
which include obtaining hospital records, doctor's
reports, expert's fees for investigating causes of
accidents, preparing reports and testifying.
In the event your case does result
in monies being obtained, then those expenses are
reimbursed. Although the law and most firms require
a client to pay back the lawyer for all expenses
incurred, whether or not any money is ever
collected, Chase and Chase do not obligate their
clients to reimburse them for expenses if they are
not successful in obtaining money for a client.
I may have been partially at
fault in causing the accident and being injured. Do
I still have a case?
Yes. Under New Jersey law, you
have the right to collect damages (money) from
someone causing you injury if their fault is greater
(at least 51%) than your own. The amount you recover
will be reduced by the percentage of fault you
contributed to causing the accident - whatever type.
Do the lawyers assist in
processing my claims with my insurance company for
payment of my medical bills?
At Chase and Chase? Yes, as part
of our handling of your case.
Will I have to go to Court? A. Not necessarily. A very small
percentage of all lawsuits actually result in a jury
trial. Most cases settle without a trial and many
settle without a lawsuit actually being filed.
However, all cases are different and the outcome of
any case cannot be predicted.
